2. Collection and storage of personal data and nature and purpose of its use

a) When you visit our website
When you visit our website www.fuchs-umwelttechnik.com, the browser used on your device automatically sends information to our web server. This information is temporarily stored in what is known as a log file. The following information is collected without your intervention and stored until it is automatically deleted:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the file retrieved,
  • Website from which access is made (referrer URL),
  • Browser used and, where applicable, operating system of your computer as well as the name of your Internet Service Provider.


The abovementioned data will be processed by us for the following purposes:

The lawful basis for data processing is Article 6(1)(f) of the GDPR. Our legitimate interest derives from the purposes listed above for data collection. Under no circumstances do we use the data collected for the purpose of identifying you as a person.

Fuchs Umwelttechnik uses products and services for analysis and marketing purposes, which are provided by Visable GmbH (www.visable.com) in cooperation with them. To that end, pixel-code technology is used to collect, process and store data in order to create at least pseudonymised, but where possible and meaningful, completely anonymous user profiles. Data collected, which may initially still include personal data, is transmitted to Visable or is collected directly by Visable and is used to create the aforementioned user profiles there. Visitors to this website are not personally identified and no other personal data is merged with the user profiles.

b) When you register for our newsletter
Users have the opportunity on our website to subscribe to a newsletter. We use a double opt-in process to ensure legal certainty and compliance with data privacy. The potential recipient first receives an e-mail with a confirmation link. Only after receiving confirmation is the address added to the distribution list. You can revoke your consent to the storage of your data and the use of your address for sending the newsletter via the unsubscribe link at the end of each newsletter. The personal data transferred to the data controller when you subscribe to the newsletter comes from the associated sign-up form. When you register for the newsletter, we also store the IP address assigned by your Internet Service Provider (ISP) to the computer system you used at the time of registration, as well as the date and time of registration. The collection of this data is necessary in order to be able to trace any (potential) subsequent misuse of a data subject's email address and therefore serves as a legal safeguard for the data controller. The personal data collected when subscribing to the newsletter will be used for the sole purpose of sending out our newsletter. Subscribers to the newsletter may also be contacted by email where this is necessary for the operation of the newsletter service or for registration to it, such as in the event of changes to the newsletter service or changes in technology. The personal data collected as part of the newsletter service will not be passed on to third parties. We use tracking codes in the newsletter (but not in the system emails for subscribing and unsubscribing) to track opening and click rates in order to record the opening of the newsletter and the accessing of web links. These are recorded using a pseudonymised storage system where all personal data (e.g. email address) is replaced with an identification number (pseudonym). This means that we do not store any personal data together with usage data such as the opening of newsletters or accessing of web links. We also ensure that this data cannot be amalgamated at a later date. If you as a recipient wish to object to this pseudonymised tracking, you can unsubscribe from the list by using the opt-out link at the end of each newsletter.

c) When you use our contact form
If you have any questions, you can contact us via a form provided on the website. A valid email address must be provided here so we know who sent the request and can respond to it. Additional information may be provided at your discretion.
Data processing for the purpose of contacting us is carried out in accordance with Art. 6(1)(a) of the GDPR based on your freely given consent.


3. Data transfer


Your personal data will not be transferred to third parties for purposes other than those listed below.
We will only pass on your personal data to third parties if:
you have given your express consent in accordance with Art. 6(1)(a) of the GDPR,
the disclosure pursuant to Art. 6(1)(f) of the GDPR is necessary for the establishment, exercise or defence of legal claims and there is no reason to assume that you have an overriding legitimate interest in your data not being disclosed, in the event that there is a legal obligation to pass on data pursuant to Art. 6(1)(c) of the GDPR, and this is legally permissible and required for the execution of contractual relationships with you pursuant to Art. 6(1)(b) of the GDPR.

4. Cookies

We use cookies on our site. Cookies are small files that are automatically created by your browser and stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not cause any damage to your device and do not contain viruses, Trojans or other malware.

livestep.one

We use livestep.one to obtain the legally prescribed cookie consents (consent data) of our website users. Consent data include the following data:

5. Analytics tools


a) Tracking tools
The tracking tools listed below are used by us on the basis of Art. 6(1)(f) of the GDPR. We use them to ensure our website's design is fit for purpose and to support its continuous optimisation. We also use them to capture statistical information on the utilisation of our website and to analyse it for the purpose of optimising our service to you. These interests are considered legitimate within the meaning of the aforementioned regulation.

b) Google Adwords Conversion Tracking
We also use Google Conversion Tracking to gather statistical information on the use of our website and to analyse it for the purpose of optimising our website for you. Google Adwords places a cookie (see section 4) on your computer if you have come to our website via a Google advertisement.

These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages on the AdWords customer's website and the cookie has not expired, Google and the customer will be able to tell that the user clicked on the ad and was directed to that page.

Each Adwords customer receives a different cookie. This way, cookies cannot be traced across the websites of Adwords customers. The information collected using the conversion cookie is used to generate conversion statistics for Adwords customers who have opted for conversion tracking. Adwords customers find out the total number of users who have clicked on their ad and were directed to a page with a conversion tracking tag. They do not, however, receive any information that identifies users personally.

IP anonymisation
We use Google Analytics in conjunction with its IP anonymization function. This ensures that Google shortens your IP address within member states of the European Union or member states of the European Economic Area prior to transmission to the USA. There may be exceptions where Google transmits the full IP address to a server in the United States and shortens it there. Google uses this information on our behalf to evaluate your use of the website, to create reports on website activity and to provide us with other services relating to website and internet use. The IP address transmitted by Google Analytics is not combined with other Google data.

6. Privacy policy for the deployment and use of YouTube

The data controller has integrated elements from YouTube into this website. YouTube is an Internet video portal that enables video publishers to post video clips and other users to view, rate and comment on these clips, all free of charge. YouTube allows the publication of all types of videos such that whole films and television programmes as well as music videos, trailers or videos made by users themselves can be accessed via the Internet portal.

Each time a page from this website operated by the data controller is retrieved and there is a YouTube element (YouTube video) integrated into that page, the element prompts the web browser on the data subject's device to automatically download from YouTube a thumbnail of the respective YouTube element. Further information on YouTube can be found at www.youtube.com. As part of this technical process, YouTube and Google obtain information about which specific subpage of our website is being visited by the data subject.
If the data subject is simultaneously logged into YouTube, YouTube recognizes which specific subpage of our website the data subject is visiting when they retrieve a subpage containing a YouTube video.
